Theft of a Pedal Cycle – Successful Defence

We recently represented a client charged with the theft of a pedal cycle before the Magistrates’ Court. From the outset, our client maintained his innocence and entered a not guilty plea.

A key aspect of the prosecution’s case relied on CCTV footage, which was said to identify our client as the individual responsible. In order to properly assess this evidence, we instructed an independent imagery expert to conduct a detailed forensic review of the footage.

The expert’s report was clear and decisive. It concluded that the CCTV material provided no evidential support for the assertion that the individual depicted was our client. The report highlighted limitations in the quality and resolution of the footage, which undermined any reliable identification. It also considered observable physical characteristics and found inconsistencies with our client’s appearance.

This expert evidence was formally served on the prosecution in advance of trial. Upon review, and in light of the weaknesses identified, the prosecution discontinued proceedings the day before the listed trial date.

All charges were withdrawn, and our client was acquitted without the need for a trial.
