Acquittal Following Serious Organised Crime Trial at Derby Crown Court

Sahota & Sahota Solicitors recently secured the acquittal of a client following a lengthy and highly complex 44-day trial at Derby Crown Court involving allegations of large-scale organised cocaine trafficking.

The case involved a substantial multi-handed prosecution brought by the East Midlands Special Operations Unit (EMSOU) involving allegations of organised Class A drug supply networks operating across Derby and nationally.

The prosecution alleged that multiple defendants were involved in sophisticated criminal enterprises responsible for the wholesale movement and supply of significant quantities of cocaine throughout Derby and the Midlands.

Our client, faced allegations linked to the alleged transportation and facilitation of high-level cocaine trafficking activity.

Following trial, the jury acquitted our client of all counts he faced.

Large Scale Serious Organised Crime Investigation

Operation Daybreak was a major police investigation involving:

  • Long-term surveillance operations;
  • Mobile phone and call data analysis;
  • Cell site evidence;
  • Vehicle tracking and ANPR evidence;
  • Financial investigation material;
  • CCTV evidence;
  • Drug seizure evidence;
  • Analysis of internet-based communications;
  • Alleged links between multiple organised crime groups.

The prosecution case centred around allegations that several defendants operated within sophisticated organised crime groups involved in the wholesale multi-kilo distribution of cocaine.

The prosecution alleged that the groups communicated using multiple mobile devices, encrypted applications such as Telegram and regularly changing telephone numbers in an attempt to frustrate law enforcement.

The Allegations Against Our Client

The prosecution alleged that our client was closely associated with another alleged high-level participant and had assisted in meetings and movements said to be connected to the supply of cocaine.

The prosecution relied heavily upon:

  • Telephone call data;
  • Cell site analysis;
  • Vehicle movement evidence;
  • Alleged co-location evidence;
  • CCTV footage;
  • Inferences said to arise from association and travel patterns.

The prosecution alleged that meetings in Derby linked to the movement of cash and drugs demonstrated participation in organised Class A drug trafficking.

Specialist Defence Strategy

Sahota & Sahota Solicitors adopted a detailed and highly proactive defence strategy from the outset.

This was not a straightforward criminal case. The prosecution relied upon vast quantities of technical telecommunications evidence together with extensive surveillance material spanning many months.

The defence team conducted detailed analysis of the prosecution evidence and instructed specialist experts to challenge key aspects of the prosecution’s case, including:

  • Telephone device evidence;
  • Mobile phone attribution;
  • Cell site analysis;
  • Call data interpretation;
  • Communications evidence;
  • Inference evidence arising from alleged associations.

The case required extensive preparation due to the scale of the evidence, complexity of the prosecution allegations and the serious nature of the charges.

The Trial

The matter proceeded to a 44-day jury trial at Derby Crown Court.

The trial involved extensive legal argument, technical evidence and detailed examination of telecommunications material.

The prosecution sought to portray the defendants as participants in sophisticated organised criminal networks involved in wholesale cocaine trafficking across multiple regions.

Sahota & Sahota Solicitors worked closely with leading defence counsel Sukhdev Garcha of Priory Court Chambers throughout the proceedings.

The defence robustly challenged the prosecution’s interpretation of the evidence and the assumptions the prosecution sought to draw from mobile phone activity, location data and alleged associations between defendants.

Jury Acquittal

Following conclusion of the trial, the jury returned not guilty verdicts in relation to our client. He was acquitted of all counts he faced.

The acquittal followed months of preparation and one of the most substantial organised crime prosecutions heard at Derby Crown Court.
