No Further Action for Client Arrested on Suspicion of Conspiracy to Murder

Sahota & Sahota Solicitors recently represented a client who was arrested on suspicion of conspiracy to murder and interviewed by the police. The client was released on police bail while the investigation continued. After approximately six months on police bail, we have now been informed that no further action (NFA) would be taken against them for conspiracy to murder. They were not charged with the offence.

An investigation remains ongoing and a related criminal case is before the Crown Court. We therefore cannot publish details of the allegations, the evidence or the people involved.

What is conspiracy to murder?

Conspiracy to murder is an allegation that two or more people agreed to pursue a plan involving the killing of another person. To prove the offence, the prosecution must establish that the defendant knowingly took part in the agreement and intended that the person would be killed. An intention to cause serious harm alone is not enough.

The allegation does not depend on a killing or an attempted killing. In law, a conspiracy can be complete once the agreement is made, even if no steps are taken to carry it out. Whether there was a genuine agreement and whether a particular person knowingly joined it are therefore central questions. (www.legislation.gov.uk)

Representation from the police interview onwards

An allegation of this seriousness calls for careful advice from the outset. We represented our client during the police interview and remained instructed while they were on bail awaiting a decision.

For our client, the decision to take no further action brought an end to six months of uncertainty over a grave allegation. It also demonstrates why anyone arrested for a serious offence should obtain legal advice before answering questions in interview.
