We represented a youth Defendant who was sentenced to a Youth Detention Order in April 2021 having been charged with one count of grievous bodily harm (GBH). This was the Defendant’s first offence. There were serious concerns that the Defendant was undiagnosed for ADHD and other conditions, all of which had not been taken into account by the Court or Probation. An appeal was lodged at Warwick Crown Court and an application for bail pending appeal was submitted. We were successful in securing the Defendant bail pending the appeal. The Defendant had been referred to CAMHS when he was 12 (now 16) and was still on the waiting list. We instructed an independent expert who confirmed a diagnosis of ADHD and ASD, amongst other conditions. This was welcome news as the Defendant could now start to receive the support and assistance that he required. The matter was brought back before the Court and at the Appeal Hearing the Defendant was sentenced to a Referral Order. |
