We recently acted for a client who faced serious allegations of affray and possession of an offensive weapon following a large-scale disorder outside a nightclub in Milton Keynes. The case involved CCTV footage, multiple witnesses and a lengthy investigation. From the start the Prosecution treated the incident as a major public disorder and our client was initially remanded in custody.

The case took more than twelve months to reach trial. Throughout that period we maintained close contact with the client, explored the CCTV and witness evidence, and advised on the likely issues the jury would need to consider. Affray and offensive weapon charges often turn on what the defendant’s specific role was within a wider incident, which made the detail of the footage critical.
Plea on a limited basis
On the day of trial, after discussions with Counsel, our client entered a guilty plea on a carefully drafted basis that limited his role in the broader disorder. The Prosecution accepted this basis, which significantly reduced the sentencing position.

Community Order imposed
Despite the seriousness of the allegations and the early remand in custody, the court imposed a stand alone 12-month Community Order with no unpaid work or programme requirements. This was a strong outcome given the nature of the charges and the footage involved. Our client was relieved to be able to move forward with his life without any custodial sentence.
