Protecting a Section 10A Third-Party Interest in Confiscation Proceedings

Sahota & Sahota Solicitors successfully protected a client’s financial interest in her family home during confiscation proceedings brought against her partner.

Although the couple had undergone a marriage ceremony, the union was not legally recognised in England and Wales, and the prosecution therefore treated our client as a cohabitee.

We advanced our client’s Section 10A third-party interest in the family home, presenting detailed evidence of her substantial financial and non-financial contributions towards the purchase of the property, together with further financial support provided over many years. While our client was able to evidence outward payments, the Financial Investigator asserted that there was no direct proof of those funds being applied towards the mortgage or acquisition of the property.

Despite this challenge, the Court accepted our submissions and recognised our client’s beneficial interest, awarding her a defined percentage share of the net equity in the family home prior to enforcement of the Confiscation Order against her partner.

This outcome ensured that our client’s legal and equitable interests were fully protected and prevented an unjust deprivation of her share in the property.
