New Sentencing Guidelines for Blackmail, Kidnap and False Imprisonment Offences: 12th February 2025

The Sentencing Council has introduced two new sentencing guidelines for blackmail, kidnap and false imprisonment, marking the first time such offences have been subject to structured judicial guidance. These new measures, developed following extensive consultation, aim to assist judges in delivering consistent and proportionate sentences that reflect the seriousness of these crimes.

Blackmail Offences

The first guideline focuses on blackmail, an offence that typically involves coercing a victim into handing over money or property under threat of harm. The new approach recognises not only the financial implications of blackmail but also the psychological distress suffered by victims. Sentencing will now take into account the impact on the individual, rather than just the monetary value of the demand.

Kidnap and False Imprisonment

The second guideline addresses both kidnap and false imprisonment. Kidnap occurs when a victim is forcibly taken or transported against their will, while false imprisonment involves unlawfully restraining someone’s freedom of movement. The guidelines acknowledge the significant physical and psychological harm these offences cause, with particular emphasis on cases that arise in the context of domestic abuse.

The new guidelines apply to adult offenders sentenced in England and Wales and will come into effect for sentencing on and after 1st April 2025.
